1. Purpose and the Parties

This End User Agreement is a contract between Clan Match Exchange Good Game Ltd (hereinafter "CMAX" or "Marketplace") and the End User. All parties agree to follow the Finnish Law. The court is in Espoo. This contract is binding when the End User has registered on the Marketplace by clicking the Agree -button on the registration -form and the Marketplace has accepted the End User by creating a login name.

2. The Rights and Obligations of the Marketplace

2.1. The Marketplace has right to terminate providing the Services and thisEnd User Agreement, if the End User abuses, hacks, otherwise misuses or disturbs theMarketplace or the Services, without any prior notice. The Marketplace shall not returnany advance payments.
2.2. The Marketplace is not responsible for the usage of Services by the End User, or the their content.
2.3. The Marketplace is not responsible for the quality, security, availability or other thigs, but the Service is provided without obligation and as is. The Marketplace grants no Warranty or Guarantee whatsoever. The Marketplace is not responsible for expenses, losses or damages, that are caused by the usage of Services, even if the Marketplace or its Representative has knowledge of the flaw.
2.4. The Marketplace has right to change Service, user logins, passwords and other End User information.
2.5. The Marketplace is not responsible for the Third Party Services, that have beenbought from the Marketplace. If the Services provided by the Third parties have flaws,the End User must address all complaints directly to the Third Parties (eg. server providers). The Third Parties are solely responsible for the provided Service, Products,Marketing and Information available on the site.

3. Rights and Obligations of the End User

3.1. The End User is obligated to follow the Law of Finland and behave well on theInternet. The End User is obligated to compensate the damage or abuse caused to theThird Parties and the Marketplace.
3.2. The service is personal, and the End User may not assign the passwords or the Servicefor Third Parties.
3.3. The End User is obligated to notify the Marketplace of any changes in the contact information.
3.4. The End User may not try to wield or gain access to any excess usage rights or Services, that are not specified to be included in the Service. The End User is obligated to notify the Marketplace for any security issues detected.

4. Payments

4.1. The End User pays of the Services by the valid Price List. The Marketplace hasright to change the Price List at will.
4.2. The End User is obligated to pay for the Services by the due date. If the paymentsby the End User are delayed, the Marketplace has right to levy penal interest and thereminding fee. The Marketplace has right to terminate the Services and this this Contract,if the payments are delayed.

5. Termination

5.1. The Marketplace may terminate this contract for example, but not limited to, abuse or order by the authorities. The Marketplace is not obligated to return any advance payments forthe unprovided Services.
5.2. The End User may terminate this contract by notifying the Marketplace. The Marketplace isnot obligated to return any payments made whatsoever.

6. Privacy

6.1. The Data Protection Principles of the Marketplace is defined on the Privacy Policy, thatcan be found at http://www.cmax.gg/privacy.php.
6.2. The Marketplace may follow and record log information of the usage of the Customer, orgather other information for statistics and suspecting abuse or flaws, or while maintainingthe system.

7. Other Terms

7.1. The Marketplace has right to assign this contract to Third Parties.
7.2. The End User has not right to assign this contract.
7.3. The Marketplace reservers right to change this contract by informing the End User.
7.4. These terms are valid from 1.9.2004 and until new terms are released. The new terms are enforced immidiately.
7.5. The Marketplace is not obligated to provide Service or return payments in caseof Force Majeure or disruption caused by a Third Party (for example, but not limited to, disruption in data commucation).
7.6. All Immaterial Property Rights, such as model rights, trademarks, databases, copyrights, and others, are property of the Marketplace whether they are registered ornot. The Immaterial Property Rights may not be used outside the Marketplace withouta permission by the Marketplace.
7.7. The End Users under 18 years must have concent by the Guardians to order Services.
7.8. The Information on the www-site is not an offer to sell or buy Stock or other Financial Instruments, nor advice or encouragement to make the actions, unless agreed otherwise.
